Terms of Service

1. Acceptance of Terms

By accessing or using the ARC Fitness application, website at getarcfit.com, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

ARC provides a fitness and nutrition tracking platform that includes AI-powered workout generation, AI meal planning, food ingredient scanning, a clean product marketplace, social community features, and integrations with third-party fitness devices and services. ARC is available as a web application and (when released) as native mobile applications.

3. Accounts

  • You must be at least 13 years old to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information when creating your account.
  • You may not use another person's account without permission.
  • You are responsible for all activity that occurs under your account, whether or not you authorized that activity.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions & Payments

Plans

ARC offers the following subscription tiers:

  • Free: Basic tracking, social features, and community access.
  • Pro ($9.99/month or $100/year): Full AI features including workout generation, meal plan building, multi-week fitness plans, and food image analysis.
  • Trainer ($75/month or $750/year): Everything in Pro plus client management tools and trainer-specific features.

Billing

  • Subscriptions are billed in advance on a monthly or annual basis depending on the plan you select.
  • Payments are processed securely by Stripe.
  • Prices are in US dollars and may change with 30 days' notice.

Cancellation

  • You may cancel your subscription at any time through your account settings or the Stripe billing portal.
  • Cancellation takes effect at the end of your current billing period. You retain access to paid features until then.
  • Refunds are not provided for partial billing periods.

5. Marketplace

ARC operates a marketplace where verified vendors can sell health, fitness, and nutrition products. When purchasing from the marketplace:

  • Purchases are transactions between you and the vendor. ARC facilitates the transaction but is not the seller.
  • ARC verifies product ingredient safety through our scanning system, but does not guarantee specific health outcomes.
  • Refund and return policies are set by individual vendors, subject to applicable consumer protection laws.
  • Marketplace payments are processed via Stripe Connect. ARC charges vendors a platform fee on each transaction.

6. Third-Party Integrations

ARC allows you to connect third-party fitness and health services including Strava, Fitbit, Oura, Google Fit, Whoop, and Garmin. By connecting these services:

  • You authorize ARC to access and import data from those services according to the permissions you grant.
  • Your use of third-party services is subject to their own terms and privacy policies.
  • ARC is not responsible for the availability, accuracy, or security of third-party services.
  • You can disconnect any third-party service at any time from your ARC settings.

7. User Content

  • You retain ownership of content you post (photos, text, workout logs, etc.).
  • By posting content publicly, you grant ARC a non-exclusive, worldwide, royalty-free license to display, distribute, and promote that content within the Service.
  • You are responsible for the content you post and must not post content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • We reserve the right to remove content that violates these Terms.

8. AI Features

ARC uses artificial intelligence to generate workout plans, meal plans, and food product analysis. Regarding AI-generated content:

  • AI-generated workout and meal plans are for informational purposes and are not a substitute for professional medical or dietary advice.
  • Consult a healthcare professional before starting any new fitness or nutrition program.
  • AI outputs may contain errors or inaccuracies. Use your own judgment when following AI-generated recommendations.
  • Food ingredient analysis is based on available data and may not reflect the most current product formulations.

9. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Scrape, crawl, or use automated means to access the Service without permission
  • Upload malicious code, viruses, or harmful files
  • Use the Service to send spam or unsolicited messages
  • Circumvent any access controls or usage limits

10. Intellectual Property

The Service, including its design, code, branding, AI models, and content (excluding user-generated content), is owned by ARC Fitness and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

11. Disclaimers

  • The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • ARC does not guarantee that the Service will be uninterrupted, error-free, or secure.
  • ARC is not a medical provider. Nothing in the Service constitutes medical advice, diagnosis, or treatment.
  • Use of fitness and nutrition features is at your own risk. Always consult qualified professionals for health decisions.

12. Limitation of Liability

To the maximum extent permitted by law, ARC Fitness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

13. Termination

We may suspend or terminate your access to the Service at any time for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, and limitations of liability.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
